Allegation of Cheating Against Gujarat Fertility Centre Leads to High Court Directive. A man in Gujarat filed a complaint alleging that a well-known fertility centre deceived him: a DNA test reportedly proved he is not the biological father of the child born to his wife via IVF.
The couple initially sought treatment for infertility at the fertility clinic, which followed standard medical and ethical protocols. The centre first conducted a semen analysis on the husband, which reportedly showed abnormalities. He was prescribed medication and advised to repeat the test after a few months. Subsequent analysis showed normal results, and the husband’s wife underwent an Intrauterine Insemination (IUI) procedure, which did not lead to pregnancy. Medical professionals then recommended proceeding with In Vitro Fertilisation (IVF).
The couple consented to IVF, paying approximately ₹5,50,000 for the treatment, including diagnostics, medications, and injections. The husband's semen was cryopreserved in March 2024, his wife’s eggs were retrieved in April 2024, and five embryos were frozen for six months. The first IVF cycle using two embryos took place in June. Pregnancy was confirmed in September 2024, and the couple welcomed a daughter in April 2025.
Following the birth, certain health issues prompted blood group testing. Both parents were found to be O-positive, while the child was B-positive. This discrepancy led to DNA testing, which allegedly confirmed the child was biologically related to the mother, but not the husband. The couple lodged a formal complaint with the Commissioner of Police, which was later submitted to the local police station in May 2025. However, they allege that no investigation has been initiated.
They then approached the High Court, seeking a judicial directive to compel the police to register an FIR and initiate an investigation under allegations including cheating, criminal breach of trust, and forgery.
In July 2025, the judge directed the police authorities to examine the complaint and report back within four weeks.
